"A farmer should always be given highest priority in the country" whereas,the farmers of more than 70 years, 65 years and 58 years of age, surviving / depending on cultivation, bearing the bite of nature as drought and at the same time if they do not get the insurance claim amount of their damaged crops due to the negligent attitude of concerned authority / authorities, then what could be their extent of mental agony for presently surviving and for further cultivation?

    In this light, on dtd.22.11.2011 Hon'ble Dist.Consumer Forum, Jharsuguda allowed the 03 Nos.of complaint petitions and awarded insurance claims with compensations.

  2. " A Consumer should be given liberty to take Teflon facility and insure vehicle as per his choice at the time of purchasing vehicle and defects should be removed, found if any"

    In the above circumstances, the Hon'ble DCDRF, Jharsuguda, allowed a Complaint Case on dtd.28.12.2011, by awarding not only replacement of defected Motor Cycle to a new one with cost for harassment and litigation, but also directed to Opposite Parties 'not to force any consumer / let any consumer to make insurance, to have Teflon etc., as per his likes / choices at the time of purchasing of vehicle'.

  3. " Now a days, a lot of innocent consumers are being harassed by such defectiveness of ATM machines of Banks, which the concerned banks should take proper care "

    The Hon'ble DCDRF, Jharsuguda, has held to be deficient in service on the part of O.Ps(Bank) on the above observations and analysis and allowed the Complaint Case on dtd. 21.03.2012 by directing the O.Ps to credit the said non-withdrawal of amount in the bank account of the complainant alongwith compensation.

  4. "ATM facilities are provided by the banks. It is an additional facility provided to a bonafide consumer of the bank to withdraw money instantly from any ATM counter installed through out the country at any time. ATM machines are electronic machines, full of cash, which deliver money after insertion of ATM card with proper secret number. There are every chances of tempering / hanging of ATM machines by any culprit /culprits in absence of any security guard. Thus, it is the prime duty of the concerned bank to make necessary arrangements of security guard / guards in ATM counters so that, any innocent consumer
    would not fall under the net of unknown culprits, trying to cheat by tempering / hanging of the ATM machine. Now a days, such types of disputes regarding ATM are being heard on different branches of State Bank of India, particularly in comparison to the other nationalized banks, where there are absence of security guards, which extend to nothing but negligent in their service towards innocent consumers"

    On the above limelight, on dtd.12.09.2012 Hon'ble DCDRF, Jharsuguda allowed the complaint case by directing the O.P/concerned authority to provide standing circular to make arrangement/installation of security guard/guards in the ATM counter/counters installed by the O.P, and pay the disputed amount alongwith compensation to the complainant within one month from the date of receipt of this order.

"ATM facilities are services provided by banks to their consumers to withdraw money instantly at any time, at any place where ATM Booth is available and it is the duty of bank to provide protection to it’s consumers while availing service of withdrawing money from the ATM Booth, failing which, it will be treated as deficiency in service on the part of service provider i.e. Bank, so also exactly happened in the present case. Non-providing of protection to the consumers while withdrawing money from ATM Booth is nothing but, deficiency in service on the part of O.P.(State Bank of India) in the present case.
    So far as provision of O.P(State Bank of India), where there is question of protection against life and safety of money of innocent consumers are concerned, it is not the line on stone, it may be rectified, amended or extended as required, if any."

    On the above observations and analysis, the Hon'ble DCDRF, Jharsuguda pleased to allow the complaint case on dtd. 13.02.2013 with directions to the O.P. to make suitable arrangement for appointment of Security Guard in the ATM booth provided by the O.P alongwith compensation to the complainant.
